PAWS at The Underline DOG TRAINING AGREEMENT AND PET OWNER’S COMPLETE RELEASE OF LIABILITY(Required)

This Agreement and Pet Owner Complete Release of Liability (AGREEMENT) is entered into, by and between Friends of Miami Animals Foundation (“FOMA”), A Florida Nonprofit, and Pet Owner (“OWNER”) and applies to OWNER’S dog (“PET”) participating in the April 1st, 2023, PAWS at The Underline dog training workshop with Applause Your Paws. 

1. OWNER warrants and represents that OWNER is the legal owner of PET and is authorized to enter into this agreement.

2. OWNER further represents that PET is in good overall health, and is current on all vaccinations including Rabies, DHPP, Influenza and Bordetella; and that PET has NOT exhibited any aggressive behavior towards humans or other animals and does not have a history of biting.

3. ADVERTISING: OWNER agrees that FOMA may use the names and likenesses taken at the November 5 event in any promotional or marketing materials with no required compensation.

4. FOMA or its partners or agents may deny dog training services to any PET that exhibits any signs of infestation (fleas, ticks or any other parasites, illness or disease) or demonstrates aggressive or other behavior deemed inappropriate or unsafe. Unspayed females over 7 months of age will not be permitted to participate in the PAWS’ dog training event.

5. COMPLETE RELEASE OF LIABILITY & INDEMNIFICATION: OWNER assumes all risk related to their PET and PET participation in the PAWS dog training. Owner hereby indemnifies and agrees to hold harmless FOMA, its successors, assigns, invitees, lessors, officers, directors, independent contractors, present and former employees, customers and owners as well as Friends of the Underline, The Underline and Applause Your Paws from and against any and all loses, liabilities, damages, demands, actions, claims, lawsuits, fines, costs expenses. This includes but is not limited to attorney’s fees and court costs, and any veterinary costs and expenses) whether known or unknown, foreseen or unforeseen from the beginning of time arising from or related in any way to participation in the PAWS training event.

6. ENTIRE AGREEMENT/DISPUTE RESOLUTION. This agreement contains the entire agreement of the parties. Any dispute arising from this agreement shall be resolved in the Florida Circuit Court in and for Miami-Dade County. The prevailing party shall be entitled to recover its reasonable attorney’s fees and costs.
